Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the 8to18digital.com, juggul.com, or 8to18inc.com websites, any 8to18 affiliated school websites, and the 8to18 mobile application (together, or individually, the “Service”) operated by 8to18 Media, Inc (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You may not use as a username any name that is offensive, vulgar or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content in our sole discretion.
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our Service may contain links to third party web sites or services that are not owned or controlled by 8to18 Media, Inc.
8to18 Media, Inc has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that 8to18 Media, Inc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

You agree to defend, indemnify and hold harmless 8to18 Media, Inc and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
Limitation Of Liability
In no event shall 8to18 Media, Inc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
8to18 Media, Inc its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
These Terms shall be governed and construed in accordance with the laws of Illinois, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
8to18 is committed to protecting the privacy needs of children, and we encourage parents and guardians to take an active role in their children’s online activities and interests. 8to18 does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register.
What Information Do We Collect?
Our goal is to provide you with the information and products and services that are most relevant to you. To achieve this goal, we collect two types of information from you when you visit our Site: personally identifiable information you voluntarily choose to disclose and “aggregate information” about your use of our Site that is automatically collected when you visit our Site.
Personal Information You Choose to Provide
Personally identifiable information refers to information that tells us specifically who you are. We collect personal information from you when you voluntarily choose to provide it. In this connection, you may be asked to provide information such as your name, mailing and current email address, your gender, and any other personal or preference information that you provide to us. We may ask you to confirm your personal information when you contact our Customer Service department or the school or organization that manages the activities. This will allow us to protect your confidentiality by verifying your identity. Further, if you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We also collect personal information based on the type of activity you are performing on the Site. If you become a registered member, when you log in and access your personal 8to18 account, we will ask you to provide your username and password so that we can verify your identity. Similarly, when you organize or share your User Information, including your Registration Data (as defined in 8to18’s Terms of Service) on the Site with others, we may ask for additional information.
When and With Whom We Share Your Personal Information
Aggregate information refers to information your computer automatically provides to us and that is not tied back to you as a specific individual. Examples include referral data (the web sites you visited just before and just after our site), the pages viewed, time spent at our Site, and IP (Internet Protocol) addresses. An IP address is a number that is automatically assigned to your computer whenever you surf the Internet. When you request a page from our Site, our servers log your IP address to create aggregate reports on user demographics and traffic patterns for partners, and for purposes of system administration. We use this aggregated information to determine consumer trends and needs, which allows both 8to18 and our partners to operate more effectively.
Controlling the Use of Your Information
You may review, correct, update, change or delete personal information you have submitted at any time by accessing your account on the Site. By default, all of your User Information, including photos, images, and text, are private and can only be seen by you. Unless you explicitly make the User Content available to third parties (within or outside 8to18), others will not be able to access your content. If you share publicly, anyone will be able to view your content.
Our Site takes reasonable and normal precautions to protect our users’ information by utilizing advanced security measures designed to maintain data security and integrity. When you submit sensitive information, such as payment information, via the Site, we encrypt that information using secure socket layer technology (SSL). We do not store this payment information in our system. However, no system is 100% secure, and you should use caution whenever submitting important information over the Internet, whether to our Site or to any other. 8to18 assumes no liability for the interception, alteration, or misuse of the information you provide.
To ensure a secure browsing session, we use 256 bit SSL/TLS encryption, provided by the Go Daddy Security Certificate Authority (http://www.godaddy.com/ssl/sslcertificates.aspx). This can be verified by visiting one of our registration sites and clicking the lock icon next to the URL in most browsers, which will provide details on the SSL certificate. This is the same encryption technology used throughout the internet, for example on sites such as Amazon.com and Paypal.com. 8to18 uses Amazon Web Services Elastic Compute Cloud (EC2) instances within it’s own Virtual Private Cloud (VPC)
